Terms and Conditions

Introduction
These Terms and Conditions ("Terms") govern the provision of services by Benji Flies ("we," "our," "us"). By engaging our drone services, you ("Client," "you") agree to be bound by these Terms.
Services
We provide drone-based services including, but not limited to:

Aerial photography and videography

Surveying and mapping
-
Inspections (e.g. roofs, infrastructure)

Promotional and marketing content
All services will be agreed in writing prior to commencement.
Booking and Payment

A deposit of 30% is required to secure a booking.

Full payment is due within 5 days of invoice unless otherwise agreed.
Client Responsibilities
The Client agrees to:

Obtain all necessary permissions for filming on private property

Ensure safe and legal access to the site

Provide accurate project requirements and details
-
Inform us of any hazards, risks, or restrictions at the location
We are not responsible for delays or issues caused by inaccurate or incomplete information provided by the Client.
Weather and Operational Limitations
Drone operations are subject to weather conditions and safety requirements.
We reserve the right to:

Reschedule services due to unsafe conditions (e.g. high winds, rain)

Cancel or modify operations where required for safety or legal compliance
Rescheduling due to weather does not constitute a breach of contract.
Regulatory Compliance
We operate in accordance with applicable aviation laws and regulations, including those set by the Civil Aviation Authority (CAA).
Flights will only be conducted where legally permitted.
Intellectual Property

We retain copyright of all footage unless otherwise agreed in writing.

The Client is granted a non-exclusive, non-transferable licence to use the delivered content for agreed purposes only.

Redistribution, resale, or commercial use beyond agreed scope requires written consent.
Data Protection
We process personal data in accordance with our Privacy Policy.
Limitation of Liability

We will carry out services with reasonable skill and care in accordance with industry standards.

To the fullest extent permitted by law, we shall not be liable for any:

Indirect or consequential loss

Loss of profits, revenue, or business opportunities

Loss of data or use
-

Our total liability arising out of or in connection with the services shall be strictly limited to the total amount paid by the Client for the specific services giving rise to the claim.

We are not liable for:

Delays or failures caused by circumstances beyond our reasonable control (including weather, airspace restrictions, technical failures, or regulatory changes)

Any damage or loss resulting from reliance on deliverables beyond their intended purpose

Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation

Any liability that cannot be excluded under UK law

Insurance
We maintain appropriate public liability insurance for our operations.
Proof of insurance can be provided upon request.
Cancellations and Refunds

Cancellations within 24 hours of the scheduled service may incur a charge of up to 30% of the total fee.

We reserve the right to charge for work already completed.

If we cancel due to circumstances within our control, a refund or reschedule will be offered.
Deliverables

Delivery timelines will be agreed in advance.

Minor revisions (3) may be included; additional edits may incur charges.

Final deliverables will be provided in the manner agreed.
Complaints
If you are dissatisfied with our services, contact us within 3 days of delivery so we can resolve the issue.
Governing Law
The laws of England and Wales govern these Terms.
